Courts slaps 18 months on Lusaka man for assault

A MAN of Chibolya in Lusaka has been sentenced to 18 months imprisonment with hard labour by the Lusaka Magistrate’s Court for assaulting a woman.
Magistrate Ireen Wishimanga on Monday jailed Webster Muchindu, 24, for assaulting Beauty Banda and occasioning her actual bodily harm.
The offence is contrary to Section 248 of the Penal Code Chapter 87 of the Laws of Zambia
Particulars of the offence are that Muchindu on January 9, this year in Lusaka, assaulted Ms Banda.
Passing the sentence, Ms Wishimanga said she had considered Muchindu’s mitigation but that he behaved like a savage and inhumanely attacked Ms Banda despite the fact that she pleaded with him not to hurt her.
“I, therefore, find you guilty and sentence you to 18 months imprisonment with hard labour,” Ms Wishimanga said.
And in another case before the same court, a Burundian man has been fined K1, 500, in default four months imprisonment with hard labour for unlawful stay in Zambia
This is in a case in which Gilbert Buchuri, pleaded guilty to illegal stay in Zambia.
Particulars of the offence are that Buchuri between August 20 and November 20, last year, entered Zambia on a 30-day visa but exceeded his stay and was later apprehended by immigration officers.
In mitigation, Buchuri, who spoke through an interpreter, pleaded with the court to deport him to Burundi.
“I admit the charge and ask for the forgiveness of the court, do not send me to jail but to my mother country, as my younger brothers depend on me,” Buchuri said
Ms Wishimanga slapped a K1, 500 fine on Buchuri, in default four months imprisonment with hard labour.
