Man slapped KR10,000 fine for demanding divorce from wife over family dispute

THE Lusaka Boma Court has slapped a KR10,000 fine on a Chilanga man who begged for the dissolution of his four-year-old marriage because his wife has refused to apologise for insulting his mother.
The case came up for judgment after it was adjourned to allow both families time to resolve the couples marital dispute as the reasons they had advanced earlier did not warrant divorce.
This was in a case in which David Phiri, 29, sued Rebecca Phiri, 22, of the same township for divorce. The two, who got married in 2009, have two children together.
On May 2, the court had given the couple three weeks to try and resolve their marital problems.
But when the matter came up for judgment, David told senior court magistrate Morgan Kayanika that his decision to divorce his wife still stood, especially that Rebeccas family had not bothered to contact his family following the court order.
After you advised us, we waited for her family to approach us so we could discuss but they never came. But then even if they did, I do not think I would have changed my mind because I just want a divorce, he said.
The couple was in court three weeks ago after David filed for a divorce because Rebecca had refused to apologise to his mother for calling her a dog.
But Rebecca told the court that her family were of the opinion that Davids family would approach them because it was the man who had sued for divorce. She said David had actually followed her and told her that his mind was made up about divorcing her and that she had accepted his decision.
Passing judgment, the court, after observing that there was no love in their marriage, ordered that David pay KR10, 000 as compensation with an initial payment of KR500 June monthend to be followed by monthly instalments of KR250.
David was also ordered to pay KR250 as child maintenance. The couple was also ordered to share property acquired together equally.
