Security guard jailed 9 months

THE Livingstone Magistrate’s Court has sentenced a security guard from Target Security Company to nine months imprisonment for assault, suspended for two years.
This is in a case in which Nathan Mushiba appeared before Livingstone Magistrate Edsen Shanduba for assault.
Mushiba told the court that he assaulted the complainant because he was drunk with Kachasu which he used to calm pain in his leg.
Facts before the court are that the complainant was going to visit his brother when he met Mushiba.
Mushiba then accused the complainant of causing his friend to go to jail.
It was at this point that Mushiba picked a brick from the ground, hit the complainant and run away.
The complainant was helped by members of the public who reported the matter to Libuyu Police Station.
Mushiba was later apprehended and charged with assault which he admitted.
In mitigation, Mushiba told the court that he has just started work and if he is sent to prison, his family will suffer.
He also pleaded with the court for leniency saying his father will not manage to look after the family.
“The court has considered all that you have said in mitigation that you are a first offender, and you pleaded guilty to the charge.
You also told the court that you were drunk with Kachasu or Kachimpembe, when you approached the complaint,” the magistrate said.
He further said that news of Kachasu helping relief pain in the leg was the best news of this year.
“I sentence you to nine months imprisonment with hard labour which I have suspended for two years, in which you should not commit a similar offence,” Mr shanduba said.
He ordered Mushiba to pay K200 to the complainant.
